The warranty described here is frorm the Case Corporation OTHER CONDITfONS(Cont.)
and in Canada, Case Canada Corporation, both of which are referred to as 'Case IH.'
THE CASE IH COMMITMENT
Case IH provides one of the best warranty packages in the industry to the original retail purchaser or subsequent owners during the warranty period. The Case IH warranty assures that its agricultural equipment is free from defects in material or workmanship for the following periods, starting from the first warranty start date:

THE CASE [H RESPONSIBILITY
If a defect in a material or workmanship is found in a product during its warranty period, Case IH will pay parts and labor costs to repair the defect as long as the services are performed by an authorized Case IH U.S. or Canadian dealer.
If parts are needed during the repair, Case IH will, at its option, use genuine Case IH new or remanufactured parts.
EXCLUSIVE REMEDY
The remedies provided under the terms of this warranty are the purchaser's exclusive remedies and are in lieu of any other remedies otherwise available.
THE OWNER'S RESPONSIBILITY
The Case IH warranty remains in effect during the stated warranty period as long as the owner performs the required maintenance at the recommended time as outlined in each product's operators manual. Genuine Case IH or Case [H approved service parts must be used for maintenance.
Additionally, the owner will pay for all transportation or travel expenses related to any warranty repair.
OTHER CONDITIONS
Certain demonstrator, rental, or lease machines, as well as individual machines used for other company purposes such as testing, may be eligible for some or all of a new machine warranty. This does not constitute representing these units as new and/or unused and applies only to specified units sold by authorized dealers.
Please be aware that no Case IH representative has the authority to change the terms of this warranty in any manner. This written document represents the final and complete integrated expression of the warranty provided to the purchaser. Any assistance to the purchaser in the repair or operation of any Case IH product will not constitute a waiver of the terms of this warranty, nor will any such assistance extend or revive the warranty.
WHAT THE WARRANTY DOES NOT COVER
- Used and secondhand products outside of the warranty period;
- Any Case IH product and parts or components that are covered by separate and specific warranties, including but not limited to select components on Spreaders, Grinder Mixers, and Tillage Equipment;
- Items not manufactured by Case IH. These include, but are not limited to Non-Case engines, tires, fuel injection equipment, and trade accessories, which are covered by their own manufacturer's warranties;
- Replacement due to wear on ground engaging or crop processing components that require replacement due to wear in or out of warranty period;
- Normal maintenance service, such as but not limited to lubrication, engine tune-ups, and normal
maintenance items such as filters, belts, lights, bulbs, or parts used as part of normal maintenance service;
- Equipment damaged by improper use, accident, other casualty or negligence, or from operation beyond rated capacity or specifications;
- Machines equipped with nonauthorized attachments or modifications;
- Warranty on Agricultural Equipment engaged in NonAgricultural activities or For Hire will be limited to the months of coverage listed in the warranty terms, or 2000 hours, whichever comes first.
CASE IH MAKES NO OTHER REPRESENTATIONS OR WARRANTIES, EXPRESSED OR IMPLIED AND SPECIFICALLY EXCLUDES THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE. The disclaimer of implied warranties shall not apply to the extent such disclaimer is not allowed by applicable state)provincial law. CASE IH WILL NOT BE LIABLE FOR SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND OR NATURE.

9380. ADDITIONAL ENGINE WARRANTY FOR 9300 SERIES TRACTOR MODELS EQUIPPED WITH
THE CUMMINS LT1 OA (9360) AND THE CUMMINS NTA 855 (9370,9380) ENGINES IS AVAILABLE
FOR PURCHASE AS LISTED BELOW.
The 9310/9330 Engine Coverage is included in the new Purchased Protection Plan as announced on Price Bulletin FW-92-02, dated 3119192.
This optional engine protection is an available supplement when the Purchased Protection Plan is purchased for the applicable model tractor. Cummins Bulletin #3385463 (Customized Assurance Plan Certificate) must be attached to Settlement Form when buying through Case Corp.
